Terms of Service

1. Acceptance of Terms

By accessing or using the Lunar Container Tracking API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including visitors, registered users, and API consumers.

2. Service Description

Lunar provides a container tracking API that enables users to:

  • Track container availability across 150+ terminals in North America
  • Monitor Last Free Day (LFD) information
  • Receive email notifications for status changes
  • Access container data via RESTful API endpoints

We strive to provide accurate and timely information, but data is sourced from third-party terminals and may be subject to delays or inaccuracies beyond our control.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and API keys
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

4. API Usage & Rate Limits

Your use of the API is subject to the following terms:

  • API keys are personal and may not be shared or transferred
  • Usage is subject to rate limits based on your subscription plan
  • Automated scraping or excessive requests may result in throttling or suspension
  • You may not use the API for illegal purposes or to harm our infrastructure

Plan limits are enforced automatically. Exceeding your plan's tracking limit will prevent adding new containers until existing ones are removed or your plan is upgraded.

5. Payment Terms

For paid subscription plans:

  • Subscriptions are billed monthly or annually in advance
  • Payments are processed securely through LemonSqueezy, our Merchant of Record, who handles billing, invoicing, tax collection, and payment compliance on our behalf
  • Prices are in USD; applicable taxes are calculated and collected by LemonSqueezy
  • All sales are final. We do not offer refunds, as we provide a generous 30-day free trial requiring no credit card so you can fully evaluate the Service before subscribing. See our Refund Policy for details
  • We reserve the right to modify pricing with 30 days' notice to active subscribers

Failure to pay may result in service suspension. Cancelled subscriptions remain active until the end of the current billing period.

6. Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by Pauz Digital and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written consent.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAUZ DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Pauz Digital and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

Either party may terminate this agreement at any time. You may cancel your account through the dashboard or by contacting support. We may suspend or terminate your access for violation of these Terms with or without notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Delaware.
